The Calfornia Public Utilities Commission (CPUC) regulates moving companies that perform moves within California.  These moving companies must be licensed by the CUPC prior to operating.  Here are a few tips (from the CPUC) to follow before you choose a moving company.

Moving companies that are hired three or more days in advance must provide you with a copy of their moving services agreement, and also an Important Notice About Your Move document, and the Important Information For Persons Moving Household Goods (within California) booklet. The booklet provides rules and regulations that a moving company must follow and information about your rights.

• A moving company may provide you with an estimate in writing only after they conduct a visual inspection of the items you need moved.

• Verbal estimates or estimates given over the Internet are illegal and may not be enforceable.

• A moving company must provide a “Not to Exceed” price for all household moves. This is the maximum amount you can be charged unless you request additional services and those changes are then detailed in a “Change Order for Moving Services.” A Change Order cannot be used simply because a mover underestimated costs. Pay close attention to these

documents because if a fee dispute arises, the moving company may demand that you pay the cost quoted on these documents before releasing your goods.

• You may choose to purchase additional protection and set the value of your belongings for an amount that makes you comfortable. The Important Information For Persons Moving Household Goods (within California) booklet has more details on options.

• Verify that a moving company is authorized to operate by calling 800-877-8867 or you can check the company’s status from the CPUC’s website at http://www.cpuc.ca.gov and click on transportation.

• To file a complaint against a moving company, call 800-366-4782, or follow the “File a Complaint” link at http://www.cpuc.ca.gov. Loss or damage claims must be filed in writing within nine months after your goods have been delivered.

Checklist for Hiring a Moving Company in California:

When looking for a moving company:

Check with the CPUC to verify that a moving company is authorized to operate by calling 800-877-8867, or visit our website at www.cpuc.ca.gov and look under transportation.

Thoroughly research a moving company before hiring. When possible, visit the company’s place of business.

Check the company’s complaint history with the Better Business Bureau.

Do not accept a telephone or Internet “estimate”- they are prohibited and may not be enforceable. Estimates must be in writing only after inspection of goods to be moved.

Before anything is moved, make sure you receive and understand:

The booklet, Important Information For Persons Moving Household Goods (within California).

A moving service agreement.

The Important Notice About Your Move document showing a “Not To Exceed” price.

Any “Change Order for Moving Services” (if applicable).

Also, photograph or video tape your belongings to refer to if a dispute arises concerning charges and/or loss or damage.

Get copies of everything you sign before the move begins. At the end of your move, the moving company should also give you copies of the completed documents.

The developer of downtown San Diego’s largest residential high rise (Vantage Pointe San Diego) said Monday that it has halted sales on the 679-unit condo project and is returning deposits to dozens of buyers who had been awaiting the close of escrow.

The move to abandon sales marks the second time in the last year that the developer has given deposits back to buyers in the beleaguered Vantage Pointe project, which has faced one setback after another since launching sales six years ago.

“We’re not able to meet the Fannie Mae or Freddie Mac or FHA requirements in this marketplace because we can’t get enough sales,” said Randy Klapstein, CEO of Pointe of View, developer of the 40-story Vantage Pointe San Diego complex that completed construction last year in the midst of the economic downturn. “We’re not getting the traction we’d hoped for, and we don’t want our customers to stay in limbo, so it’s best to move on.”

It is now likely the $280 million East Village condo project will remain a rental complex for the foreseeable future, said Klapstein, noting that there are roughly 200 renters, about a dozen of whom are buyers who were renting while waiting for their sales contracts to be finalized.

“At this point, we’re going to continue renting Vantage Pointe San Diego,” he added.

Since defaulting on its original $210 million construction loan earlier this year, the loan has been marketed for sale, but no deal has been finalized yet. When asked whether it was possible that the condo project might be sold, Klapstein would only say, “It’s always a possibility.”

In the meantime, the Canadian developer of Vantage Pointe San Diego is in the process of returning deposits to the 40 buyers who had entered into purchase contracts. Those buyers who are living in the complex as renters have the option of remaining or working with the Pointe of View sales team to find condos to buy elsewhere in downtown, said Klapstein.

There had been as many as 100 purchasers, but 60 of those buyers opted to cancel over the last several months, said Tina West, of Sunrise Management, which was handling sales. Condo prices, she said, had ranged from $225,000 for a small one-bedroom up to $795,000, with the average two-bedroom condo selling for $400,000.

“We were very disappointed in the fact that we were unable to get the sales we were hoping for, and we think it’s a great building, but unfortunately it’s a sign of the market and there’s nothing we can do about it,” said Klapstein. “We did the best we could, we had the best marketing team and had a great product at a great price.”

While downtown’s condo market suffered during the housing bust, as most neighborhoods have, Vantage Pointe faced unique hardships that were difficult to overcome, most notably its gargantuan size that would have made it difficult to sell out even in a brisk real estate market. Its location at Ninth Avenue and B Street on the fringe of downtown’s central core also made it a harder sell for some buyers.

“Urban projects are tough and with this number of units, they’re tough to pull off unless you have smoking market conditions,” observed Peter Dennehy, vice president at John Burns Real Estate Consulting. “And the units were not particularly impressive as far as basic design and features. It really works better as a rental, and trying to do rental and sales in the same building doesn’t work because buyers really don’t want to be in a building with renters.”
